1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Tapable ("we", "us", "our") regarding your use of the Ramadani mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Ramadani is a local-first Islamic companion mobile application that provides:

• Accurate prayer times calculated locally using established algorithms
• Real-time Qibla compass direction
• Curated duaas (supplications) with Arabic, transliteration, and translation
• Tasbih (dhikr) counter with session tracking
• 99 Names of Allah with meanings and memorization tracking
• Hijri calendar with important Islamic dates
• Prayer logging and Quran reading progress
• Premium features available through subscription

3. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use this App.

4. License Grant and Restrictions

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, disassemble, or create derivative works of the App.
• Remove, alter, or obscure any proprietary notices from the App.
• Use the App for any illegal, harmful, or unauthorized purpose.
• Attempt to gain unauthorized access to any part of the App or its systems.
• Use automated scripts, bots, or similar tools to access the App.
• Interfere with or disrupt the App's functionality or servers.
• Reproduce, distribute, publicly display, or create derivative works from the App.
• Sell, rent, lease, sublicense, or transfer your rights to use the App.
• Upload or transmit viruses, malware, or other malicious code.
• Violate any applicable laws, regulations, or third-party rights.

5. User Accounts and Data

5.1 Account Creation

You must create an account to use the App. You can sign in using Apple, Google, or Facebook. Your account is managed through our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5.2 User Data

You retain all rights to any content you create within the App (such as prayer logs, tasbih sessions, favorites, and bookmarks). By using the App, you grant us a license to use, store, and process your data as described in our Privacy Policy. We will handle your data in accordance with applicable privacy laws.

5.3 Accuracy of Information

You agree to provide accurate, current, and complete information during account registration and to update such information to maintain its accuracy.

6. Premium Subscriptions

6.1 Subscription Terms

Certain features of the App require a paid subscription ("Ramadani Pro"). Subscriptions are available as monthly and yearly auto-renewable plans and are processed through Apple's App Store or Google Play Store, subject to their respective terms and conditions.

6.2 Payment

• Subscriptions are charged to your Apple App Store or Google Play Store account.
• Payment will be charged upon confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription through your App Store or Play Store account settings.

6.3 Free Trials

We may offer free trial periods for Ramadani Pro. You may be charged once the trial period ends unless you cancel before the trial expires. We reserve the right to modify or cancel free trial offers at any time.

6.4 Restore Purchases

If you reinstall the App or switch devices, you can restore your active subscription from within the App.

6.5 Changes to Pricing

We reserve the right to change subscription pricing at any time. For existing subscribers, we will provide notice before any price increase takes effect. Price changes will not apply to your current subscription period if you purchased before the change.

7. Intellectual Property Rights

7.1 Ownership

The App, including all content, features, functionality, software, design, text, graphics, logos, and underlying technology, is owned by Tapable and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Islamic Content

Duaas, Quranic content, and the 99 Names of Allah included in the App are sourced from established Islamic texts and traditions. Transliterations and translations are provided for accessibility and convenience.

7.3 User-Generated Content

You retain full ownership of data you create in the App (prayer logs, tasbih sessions, favorites, bookmarks). This content is stored locally on your device and is not transmitted to our servers unless you explicitly opt into cloud backup.

7.4 Trademarks

"Ramadani" and associated logos are trademarks of Tapable. You may not use these trademarks without prior written permission.

8. Religious Content Disclaimer

8.1 Not Religious Authority

THE APP IS NOT INTENDED TO REPLACE QUALIFIED ISLAMIC SCHOLARS, LOCAL MOSQUES, OR RELIGIOUS AUTHORITIES. The content provided is for informational and devotional purposes only and should not be considered a religious ruling (fatwa) or substitute for consultation with qualified scholars.

8.2 Accuracy of Calculations

While we strive for accuracy:

• Prayer times are calculated using established algorithms (Muslim World League, ISNA, Egyptian, Umm al-Qura, etc.) and may vary slightly from times announced by local mosques or authorities.
• Qibla direction is determined using your device's compass and GPS, and may be affected by magnetic interference, device calibration, or environmental factors.
• Hijri calendar dates are calculated algorithmically and may differ from dates based on moon sighting in your region.

8.3 Consult Scholars

Always seek the guidance of qualified Islamic scholars for matters of religious rulings, jurisprudence, and spiritual guidance. The App is a tool to support your worship, not a replacement for scholarly guidance.

9. Location & Sensor Data

The App requests access to your device's location services and motion sensors to provide its core features. By granting these permissions, you acknowledge that:

• GPS data is used to calculate prayer times and Qibla direction.
• Compass/magnetometer data is used to display real-time Qibla direction.
• Location data is stored locally on your device and is not transmitted to our servers.
• You can revoke these permissions at any time through your device settings, which may limit App functionality.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties regarding accuracy, reliability, or completeness of religious content, prayer times, or Qibla direction.
• Warranties that the App will be uninterrupted, secure, or error-free.
• Warranties regarding the results obtained from using the App.

11. Limitation of Liability

11.1 Exclusion of Damages

To the maximum extent permitted by applicable law, Tapable shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• Loss of data or interruption of worship routines.
• Reliance on prayer times, Qibla direction, or religious content.
• Loss of profits, revenue, or goodwill.
• Any other intangible losses.

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.2 Maximum Liability

Our total liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Tapable, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Third-Party Services

The App integrates with third-party services including Clerk (authentication), RevenueCat (subscriptions), and Expo (app infrastructure). We are not responsible for:

• The availability, accuracy, or content of third-party services.
• Third-party privacy practices or terms of service.
• Any damages or losses caused by third-party services.

Your use of third-party services is governed by their respective terms and privacy policies.

14. Modifications to the App and Terms

14.1 Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14.2 Changes to Terms

We may revise these Terms from time to time. The "Last Updated" date at the top of these Terms indicates when they were last revised. Material changes will be notified through the App or on our website. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

15. Termination

15.1 Termination by You

You may stop using the App and delete it from your devices at any time. Deleting the App does not automatically cancel paid subscriptions — you must cancel through your App Store or Play Store account.

15.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

15.3 Effect of Termination

Upon termination:

• All licenses granted to you will immediately terminate.
• You must cease all use of the App and delete it from your devices.
• Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

17. Apple and Google Specific Terms

17.1 App Store Terms

If you access the App via Apple's App Store, you acknowledge that:

• These Terms are between you and Tapable, not Apple.
• Apple has no obligation to provide maintenance or support services.
• Apple is not responsible for addressing any claims relating to the App.
• Apple is a third-party beneficiary of these Terms and may enforce them.

17.2 Google Play Terms

If you access the App via Google Play, you agree to Google Play's Terms of Service, which can be found at https://play.google.com/intl/en_us/about/play-terms/.

19. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE APP.
